Reuters: Apple in talks to stream films owned by Epix, no deal expected before September

It's reasonably well known at this point that Apple is looking to line up partnerships for some sort of a streaming video service. We've heard again and again that it's coming, so get ready to hum along with that 'ol tune one more time. Reuters is reporting that Apple has been in negotiations with Epix since earlier this year, hoping to secure access to films from Lions Gate, MGM and Paramount Pictures. There's no indication of when such a service might come to light, but Reuters indicates the company's current deal with Netflix, which expires on September 1st, could be a conflict (though that hasn't stopped Google TV in the past). So, no proper Apple-branded TV until the fall? Stay tuned...

Latest NFL concussion suit cites Saints' bounties

ATLANTA (AP) ? The four former NFL players who sued the league on Monday in a state court in Atlanta could be leading a wave of new lawsuits that cite the New Orleans Saints' bounty system for hard hits as evidence that pro football didn't properly protect its players from concussions.

Legal experts and trial attorneys say they expect more complaints against the NFL to point to the Saints' scandal after the ex-players filed suit contending the bounty system was another example that the league "explicitly relied on violence" and neglected to educate players on the dangers of concussions.

The claims give the new lawsuit an "added vitality" if attorneys can use it to bolster the idea that there's activity in the sport that goes beyond the typical violence associated with pro football, said Paul Haagen, co-director of the Center for Sports Law and Policy at Duke University.

"It adds color" to the complaint, Haagen added. "And by raising it you hope to raise a general buzz in the public that this is an issue."

The NFL's investigation found that former Saints defensive coordinator Gregg Williams offered thousands of dollars in cash payouts for violent hits over the past three seasons, including when the team won the Super Bowl. And while the four players named in the lawsuit don't claim to be victims of the scheme, they say it is indicative of a culture that has left them and other ex-players with debilitating conditions.

"There is nothing new or unique about what Gregg Williams said. Although the NFL has now punished Williams and the Saints, for almost its entire history the NFL glorified violent hits," said the complaint. "It encouraged its players to think of themselves as gladiators. But, along the way, the NFL failed to educate its players about the consequences of such a win-at-all costs mentality."

NFL spokesman Brian McCarthy said any allegation that the league intentionally sought to mislead players is without merit.

"It stands in contrast to the league's actions to better protect players and advance the science and medical understanding of the management and treatment of concussions," he said.

The lawsuit was filed on behalf of Myron Guyton, who played for the New York Giants and New England Patriots in the 1980s and 1990s; Lomas Brown, who played for five teams over a 17-year career that ended in 2002; Jessie Small, who played for the Philadelphia Eagles, the Phoenix Cardinals and the Houston Oilers between 1989 and 1993; and Willie Whitehead, who played for the San Francisco 49ers and New Orleans Saints from 1995 to 2006.

Atlanta attorney and NFL agent Von DuBose filed the lawsuit on behalf of the four players and their wives. He said the men suffer from memory loss, headaches, depression and other symptoms characteristic of those with traumatic brain injuries. They are among more than 1,000 former NFL players suing the league, according to lawyers involved. The cases say not enough was done to inform players about the dangers of concussions in the past, and not enough is done to take care of them today.

"I've been hearing this stuff for years. And it instantly made sense when this concussion information started to come out," said DuBose. "The dots started to connect."

Gabe Feldman, a sports law professor at Tulane University, said the reference to the bounty system could help plaintiffs paint a picture of the sport as "not only violent but unnecessarily violent." Although he doubts the new claim will be a "game changer," he expects more lawsuits to cite the scandal.

"It certainly could be persuasive in the eyes of a jury," he said.

The complaint filed Monday goes far beyond targeting the bounty system. It also says the league encouraged players to view themselves as warriors and sold films that lionized the most brutal hits, such as the 1992 NFL Films production, "The Best of Thunder and Destruction." And it seeks to force the league to better educate players on the dangers of traumatic head injuries during the crucial period immediately after the draft.

The league's investigation found that Williams offered off-the-books cash payments of $1,500 for "knockouts," in which an opposing player was knocked out of a game, or $1,000 for "cart-offs," in which an opponent needed help off the field. The league has said the bounty pool grew as large as $50,000, and that as many as 27 Saints defenders may have taken part.

The investigation led to the indefinite suspension of Williams, who had taken a position with the St. Louis Rams and has since apologized for running the system, and the season-long suspension of Saints coach Sean Payton, who was found to have initially lied about the existence of a bounty program and instructed his defensive assistants to do the same.

NFL commissioner Roger Goodell last week rejected an appeal of Payton's season-long suspension.

Some legal analysts said claims from players who weren't involved in the bounty system may not survive a challenge from defense attorneys.

"Everyone knows, including anyone who's played in the NFL, that it's a violent game, said Matthew Mitten, the director of the National Sports Law Institute at Marquette University. "You didn't need the unfortunate circumstances of bounty-gate to tell us that."

But Bruce Hagen, an Atlanta attorney who has filed two lawsuits involving 33 different players, said the bounty system could play an important part in the lawsuits working their way through the courts.

"It shows that it's an institutionalized effort by management to go outside the bounds of the game as a way to motivate players even if it means intentionally having them injured," he said. "And that's wrong."

Geotagging, SD cards and the latest Android privacy/security issue

There's been a new twist uncovered by the folks at The Verge about apps with no permissions accessing the SD card, and to keep the sky from falling we're going to break down what is going on. 

If you haven't read it yet, the stock Android gallery (in versions prior to Android 3.0) decodes Geotags automatically when you sync with your online Picasa gallery, and it stores the information in a cache file on the SD card. This is done so the gallery can be sorted by location. What wasn't  mentioned is that this data is already present if you Geotag your images, it's just in a different form. Take this lovely photo:

Open it on any computer and look at the EXIF data (and yes, an app could be written to easily do this on your Android device itself):

Those are pretty exact latitude and longitude coordinates. Plug them into the Google Maps website and you'll get this in seconds:

That's within feet of where Alex was standing when he took this picture. All without this security "hole" being involved, and it took less that 60 seconds to do. 

Is this a good thing? Why, hell, no it's not, at least from a security/privacy standpoint. If you're taking pictures at home and geotagging is turned on, anyone who finds your phone (or a malicious app) would be able to find out exactly where you live. Or work. Or sleep. Or pick up your kids. Or cheat on your spouse.

But -- and this is important -- it is something you said was OK to do when you decided to mark your pictures with a location. And geotagging is hardly a new phenomenon. That's why we mentioned that you may want to turn Geotagging off in your camera

And before anyone starts saying Google should encrypt or force permissions on the pictures folder, understand that means you'll need a bloated, OEM-approved program for your computer that can decrypt and have permission to access the pictures you take. Nobody wants to have to use aTunes to see their photos. Nobody.

Removable storage was designed to be read from any other device. That means the data on it is wide open for the world to see. This isn't going to magically change as long as removable storage is included on devices. We have to take responsibility for our actions, and if we said it was OK to share location data for the pictures we take, that means it's OK to share location data for the pictures we take. It's a side-effect of having removable storage that other devices can read, and the only way to keep things in check is to understand the implications of what you're doing. You may not like it, but unless you design a better method, this is the way it's going to be.

Never store any data you feel is sensitive on removable storage, no matter what mobile device you're using. If an app is storing data on your removable storage you feel is too sensitive, then stop using that app. 

Hopefully, this helps you understand what's happening a bit better. Now go shut off the location in your camera app if you need to.

With the days getting longer and the spring sun creeping into the evening hours this week, we saw a host of impressive solar energy projects that put those rays to work. Kyocera revealed their plan for Japan's largest solar farm and French company Areva announced they will be building the largest solar installation in Asia. On the other side of the globe, New York City was proud to say that it recently tripled its solar power production and a new study showed that the United States pulled ahead of China in the clean energy race this year. We also saw designs for a new solar satellite that could harvest the sun's rays 24/7 and we ogled photos of the Image massive array of PV panels topping the zHome complex in Washington. A team at Natcore blew away the scientific community by creating the "blackest" solar cell ever designed and Panasonic gave us a sneak peek at its shimmering, solar-powered "Photosynthesis" Ecosystem installation, which will light up the night at the Milan Furniture Fair next week.

In green transportation news, Justin Bieber's blindingly shiny chrome Fisker Karma had people talking (and putting on their sunglasses), while the former head of R&D at GM predicted that we'll see driverless cars by 2020. Honda announced that it is teaming up with Zipcar to provide EVs and hybrids to Zipsters and Ferrari confirmed that its future V12 models will have a new hybrid system. Finally, SolarWorld sent us news about their new Elektra solar-powered plane, which can fly twice as far as its predecessor.

Smart design continued to make the world a little better with innovations like this vibrating glove that lets blind people text and Montessori's Intro to Letters app, which teaches kids the alphabet. We also got back into nature (literally) with these see-through bubble tents surrounded by trees, and we reflected upon the mysterious human-shaped mirror sculptures that popped up in a Scottish forest.

I'm deploying in a month. What will be out when I return? When I get back around beginning 2013, what is your speculation of the phone I will be to get.

I'm feeling I will be able to get a phone with a 4.8 inch 720p screen, quad core, 1.5GB ram. It will have 64GB internal memory (because as nice as the cloud is, it does NOT work in all the places the military works.) It will have a SDcard slot, 3000 mAh minimum battery, and will feature actual stereo speakers (on the back in landscape mode) I honestly do not care about the thinness, but hopefully around the same thickness as a Droid Charge.

A small Bezel on top and bottom, (for holding) and a minimal Bezel on the sides. The camera won't have more than 10MP, but will be better engineered to not suck ass. The front-facing camera will be 5MP. Soft keys only on the screen, and there WILL be an actual camera button with 2 stages. Bootloader will be un encrypted (because that's the problem). Also, will be a Verizon device.

What are your hopes for an actual early 2013 device?

Hey, Casen! First off, thanks for doing what you do. As for the phone, a lot of what you're expecting is likely in the natural progression of smartphones. I'd certainly love to see 64GB of on-board storage (and for it to be economical to have), as well as the larger battery. But I'm also pretty well convinced that the major shift in 2012 going into 2013 is going to be interoperability among devices. Wifi Direct's likely to play a pretty big role in Android's plans for taking over living rooms as well as running what's in your pocket. And we're talking about beyond Google TV. And don't forget that we've still got Intel-based Android devices to look forward to later this year. 

Hardware is hardware. It'll always get better. It's where we imagine the software's at in 2013 that really has us excited.
